Surplus monies

In plain English: Unless the declaration says otherwise, any leftover association money after common expenses and reserve contributions are covered is returned to the unit owners in proportion to their share of the common expenses, or credited toward their future assessments. In short, surplus funds flow back to the owners rather than staying with the association.

33-1254. Surplus monies

Unless otherwise provided in the declaration, any surplus monies of the association remaining after payment of or provision for common expenses and any prepayment of reserves shall be paid to the unit owners in proportion to their common expense liabilities or credited to them to reduce their future common expense assessments.
